Atelier Baks

These general terms and conditions apply to all orders placed with Atelier Baks, a sole proprietorship located at Hertog Godfriedstraat 30, 5231XG 's-Hertogenbosch, registered with the Chamber of Commerce under number 98468979.

Article 1 – General
1. These general terms and conditions apply to every offer from Atelier Baks and to every distance contract concluded between Atelier Baks and the consumer.
2. By placing an order, the consumer agrees to these general terms and conditions.
Article 2 – Products
1. Atelier Baks designs and sells custom-made and personalized fabric bunting and garlands.
2. The products are handmade; therefore, slight deviations from the examples shown may occur.
3. Personalized products are unique and made especially for the consumer.
Article 3 – Colors and display
Atelier Baks makes every effort to display colors and materials as accurately as possible. Actual colors may vary due to screen settings or lighting. Such variations do not constitute grounds for complaint or cancellation.
Article 4 – Conclusion of the agreement
1. The agreement is concluded when the consumer places an order via the website and the payment has been successfully completed.
2. After payment, the consumer will receive a confirmation and an invoice by email.
Article 5 – Prices and payment
1. All prices are stated in euros, including VAT and excluding shipping costs, unless otherwise stated.
2. Payment is made in advance via the offered payment methods (such as iDEAL or bank transfer).
3. Atelier Baks will only start production and shipping of the order after receipt of payment.
Article 6 – Delivery times
Because the products are handmade and custom-made, the stated delivery times are indicative. A slight delay in delivery time does not entitle the consumer to compensation or termination of the agreement.
Article 7 – Delivery
1. The products are shipped via letterbox boxes to the address specified by the consumer.
2. Atelier Baks strives to ship orders within the agreed-upon timeframe. Any delays will be notified to the consumer in a timely manner.
3. Atelier Baks is not liable for delays or damage incurred during shipping by PostNL or another carrier.
4. Atelier Baks reserves the right to combine multiple orders from the same customer, placed within a short period of time, into one shipment, unless the customer has indicated otherwise in advance.
Article 8 – Right of withdrawal
1. For standard (non-personalized) products, a statutory reflection period of 14 days after receipt applies.
2. For personalized or custom-made products, the right of withdrawal is excluded in accordance with Article 10, paragraph 3, of the Distance Selling Act.
3. If a product is defective or has been delivered incorrectly, the consumer must contact Atelier Baks within 7 days of receipt via anneke@atelierbaks.nl.
Article 9 – Customization and approval
The customer is responsible for providing correct information (such as names, colors, or text) for personalized products. Atelier Baks will process the order based on the information provided. Errors resulting from incorrect or incomplete information provided by the customer are not covered by any warranty or liability of Atelier Baks.
Article 10 – Warranty and complaints
1. Atelier Baks guarantees that the delivered products comply with the agreement and the reasonable requirements of soundness and usability.
2. If there is a complaint about the product or service, the consumer can submit a complaint by email within 14 days of discovery.
3. Atelier Baks will respond within 14 days of receiving the complaint with a substantive solution or proposal.
4. If the complaint is not resolved satisfactorily, the consumer can turn to the European ODR platform (ec.europa.eu/consumers/odr).
Article 11 – Intellectual property
All designs, photos, texts, and images on www.atelierbaks.nl are the property of Atelier Baks and may not be copied, reproduced, or used for commercial purposes without prior written permission.
Article 12 – Promotional material
Atelier Baks may use photos of completed products for promotional purposes (such as on the website and social media), unless the customer explicitly indicates otherwise when placing an order.
Article 13 – Liability
1. Atelier Baks is not liable for damage caused by incorrect use of the delivered products or by incorrect information provided by the consumer.
2. Atelier Baks' liability is at all times limited to the amount paid by the consumer for the product in question.
Article 14 – Personal data and privacy
1. Atelier Baks processes personal data solely for the processing of orders, delivery of products and communication with the consumer.

Article 15 – Force Majeure
1. In the event of force majeure (such as strikes, natural disasters, fire or disruptions to carriers), Atelier Baks is not obliged to fulfil its obligations.
2. Atelier Baks will inform the consumer as soon as possible about a situation of force majeure.
Article 16 – Applicable law
1. All agreements between Atelier Baks and the consumer are exclusively governed by Dutch law.
2. Disputes will be submitted to the competent court in the district in which Atelier Baks is located.
